Judge Refuses To Dismiss Lawsuit Against QB Ben Roethlisberger

A Nevada judge refused a request by Ben Roethlisberger to dismiss a lawsuit accusing the Steelers quarterback of raping a casino worker, Washoe County District Judge Brent Adams issued the order last night. The Reno judge also refused to drop a fraud claim against the Steeler quarterback, strike portions of the lawsuit, speed up the evidence discovery process or dismiss the lawsuit because the accuser's employer was not included as a defendant. Lawyers for Roethlisberger have accused the woman of making up the allegations in order to extort money from the two-time Super Bowl champion.

Not surprising. At this point of the proceedings its not about the evidence - i.e. as long as there are some facts  supporting an argument it stays.  It doesn't matter if there is 1 fact supporting and 10 facts opposing.

Civil law vs. criminal law.  Even in a more conservative judicial district, dismissal of a lawsuit is a very remote possibility.  You must have serious proof that the case is frivilous or fraudulent, and all we have here is my word vs. their word.

I haven't been keeping that close attention to this, but I will say that I'm a little, just a little surprised it wasn't dismissed; even considering the lower burden of proof.

Still, I highly doubt it ever goes to trial.  She is holding out for a settlement, plain and simple.  Hopefully, #7 sticks to his guns and doesn't cave.
